General Terms and Conditions
of Fechter Merch GmbH
1. Scope
1.1 These General Terms and Conditions (GTC) apply in their respective version valid at the time of ordering to all contracts concluded via the online shop of Fechter Merch GmbH (hereinafter "FM").
1.2 The contracting party is: Fechter Merch GmbH, In der Wegscheid 5, 2100 Korneuburg, Austria, Email: support@mastersofmerch.at
1.3 Deviating, conflicting, or supplementary terms and conditions of the customer will not become part of the contract unless FM explicitly agrees to their validity in writing. This applies even if FM does not expressly object to the inclusion of such terms.
2. Contract Language
The contract is concluded exclusively in German or English.
3. Conclusion of Contract
3.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to the customer to submit an offer.
3.2 The customer submits a binding offer by completing the ordering process in full and concluding the order by clicking the "Buy Now" or "Order" button.
3.3 After submitting the order, the customer receives an automatic confirmation of receipt by email. This does not constitute acceptance of the offer.
3.4 The purchase contract is concluded only when FM ships the goods. In case of partial deliveries, the contract only applies to the goods shipped in each instance.
3.5 FM reserves the right not to accept orders in case of unavailability of goods, technical errors, or impossibility of performance. Any payments already made will be refunded immediately. No further claims exist.
4. Prices and Shipping Costs
4.1 All prices are final prices in euros and include the statutory value-added tax.
4.2 Shipping costs are shown separately during the ordering process.
4.3 Orders with a value of EUR 150.00 or more are shipped free of charge within Austria and Germany.
4.4 If delivery is made in several partial shipments, no additional shipping costs are incurred.
5. Shipping, Customs, and Import Duties
5.1 Shipping takes place exclusively from Austria.
5.2 Within the European Union, no customs duties or import duties are incurred.
5.3 For deliveries to countries outside the EU (e.g., Switzerland), customs duties, import VAT, and processing fees from the shipping service provider may apply. These costs are borne by the customer.
5.4 For shipments to third countries, delivery is via UPS. UPS may charge a so-called customs clearance fee. FM has no influence on these costs.
6. Payment Terms
6.1 The purchase price is due immediately upon conclusion of the contract.
6.2 The following payment methods are available:
- Credit card (Visa, Mastercard)
- PayPal
- Apple Pay, Google Pay
- Instant bank transfer
6.3 Billing occurs immediately after order completion.
7. Delivery Times & Delivery Delays
7.1 Specified delivery times are non-binding estimates, unless expressly agreed in writing as binding.
7.2 The delivery period begins at the earliest:
- after complete payment is received and
- after all details required to execute the order are fully clarified.
7.3 Delays due to force majeure, supply chain disruptions, delays from transport service providers, or other unforeseeable events will extend the delivery period accordingly.
7.4 FM will inform the customer immediately of any significant delivery delays.
7.5 Withdrawal from the contract due to delivery delay is only permitted after setting a reasonable extension period, provided no mandatory statutory withdrawal rights exist.
8. Retention of Title
The goods remain the property of Fechter Merch GmbH until full payment is made.
9. Warranty and Liability
9.1 The statutory warranty provisions of the Austrian General Civil Code (ABGB) apply.
9.2 Obvious defects, incorrect deliveries, or transport damage must be reported immediately upon receipt of the goods by email to support@mastersofmerch.at with photographic documentation.
9.3 FM is only liable for intent and gross negligence. Liability is limited – to the extent permitted by law – to the typically foreseeable damage and a maximum of the net value of the affected order.
9.4 Liability under the Product Liability Act remains unaffected.
10. Force Majeure
FM is not liable for delays or failure to fulfill contractual obligations if these are due to events of force majeure.
Force majeure includes in particular: natural disasters, war, terrorism, pandemics, government measures, strikes, supply chain disruptions, transport or communications failures.
If a force majeure event lasts longer, FM is entitled to withdraw from the contract in whole or in part. Already made payments will be refunded; no further claims exist.
11. Data Protection
FM processes personal data exclusively in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act (DSG).

12. Right of Withdrawal (Consumers)
Consumers have the right to withdraw from the contract within 14 days without giving any reason.
(Withdrawal notice and sample withdrawal form in accordance with FAGG – remains valid unchanged, see below.)
13. Returns
13.1 The customer bears the direct costs of return shipping.
13.2 Unpostage returns will not be accepted.
13.3 Returns are only possible in unworn, undamaged original packaging.
14. Online Dispute Resolution
The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr
FM is neither obligated nor willing to participate in a dispute resolution procedure.
15. Final Provisions
15.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
15.2 Place of jurisdiction is Vienna, to the extent legally permissible.
15.3 Should individual provisions be invalid, the contract remains valid in all other respects.
